1. Introduction

This contract outlines the terms and conditions for groundwater survey services provided by VENTHA GEOTECH using Ground Penetrating Radar (GPR) technology. By engaging our services, the client agrees to these terms, including the compensation clause in case of borewell failure under the specified conditions. – Conditions updated on April 12, 2025.

2. Scope of Services

VENTHA GEOTECH will:

  1. Conduct a scientific groundwater survey using GPR technology to locate potential water sources.
  2. Provide detailed recommendations, including precise borewell points, water depth estimations, and geological insights.
  3. Offer a compensation guarantee of 25% of the borewell cost if the recommended borewell point is unsuccessful, subject to conditions outlined in this agreement.

3. Service Process

  1. Pre-Survey Requirements:
    • The client must provide accurate land details and disclose previous groundwater or drilling attempts.
  2. Survey Execution:
    • Surveys will be conducted on the agreed date, depending on weather and site accessibility.
  3. Deliverables:
    • A comprehensive survey report will be provided within 5-7 business days of survey completion.

4. Client Responsibilities

The client must:

  1. Ensure clear access to the survey site and provide necessary permissions for survey activities.
  2. Follow VENTHA GEOTECH’s recommendations precisely for borewell drilling, including depth and location.
  3. Maintain records of drilling procedures and any anomalies encountered.

5. Fees and Payment Terms

  1. A non-refundable advance of Rs.________based on field area____is required to confirm the survey booking.
  2. The remaining balance is due upon delivery of the survey report.
  3. Any additional or customized requests beyond the standard survey are subject to additional fees.

6. Risks of Borewell Failure

While VENTHA GEOTECH uses advanced GPR technology, certain risks remain:

  1. Inadequate Water Yield: Limited water flow may occur despite detection.
  2. Dry Boreholes: Geological anomalies or depletion of the water table may result in no water availability.
  3. Water Contamination: Identified water may be unsuitable due to salinity or other impurities.
  4. Geological Challenges: Subsurface conditions, such as hard rock or unstable formations, may affect borewell success.

7. Compensation Clause

If the borewell at the recommended point fails to yield any water, VENTHA GEOTECH agrees to compensate the client for 25% of the borewell drilling cost, subject to the following conditions:

  1. Eligibility for Compensation:
    • The client followed all drilling recommendations, including depth, location, and methodology, as specified in the survey report.
    • The borewell drilling was conducted within 60 days of the survey date.
  1. Exclusions:
    • Compensation does not apply in cases of:
      • Natural calamities affecting groundwater levels.
      • Client deviation from recommended drilling specifications.
      • Changes in land usage or unauthorized construction on the surveyed site.
  2. Claim Procedure:
    • The client must submit a written claim within 15 days of the drilling completion, along with:
      • The survey report provided by VENTHA GEOTECH.
      • An official invoice for the borewell drilling costs.
      • A drilling report from the contractor, detailing the process and depth reached.
  3. Payment Timeline:
    • Verified compensation claims will be processed within 30 business days of approval.

8. Liability Limitations

  1. The compensation is capped at 25% of the borewell cost and does not cover ancillary expenses such as pump installation or piping.
  2. VENTHA GEOTECH is not liable for indirect or consequential damages arising from borewell failure.

9. Cancellation Policy

  1. Cancellations must be communicated at least 48 hours prior to the scheduled survey.
  2. Advance payments are non-refundable except for cancellations initiated by VENTHA GEOTECH.

10. Indemnity

The client agrees to indemnify VENTHA GEOTECH against all claims, damages, or liabilities arising from borewell drilling unless covered under the compensation clause.

11. Governing Law

This agreement is governed by the laws of the Republic of India, and disputes shall be resolved within the jurisdiction of  Tamilnadu, India.

12. Agreement Acknowledgment

By signing this contract, the client confirms understanding and acceptance of the terms, including the risks and compensation provisions.
